Ibiza Villas 2000 Booking Terms and Conditions are subject to change without notice.
These website terms and conditions constitute the sole record of the agreement between you and The Property Management Company in relation to your use of the website. Neither you nor The Property Management Company shall be bound by any express tacit or implied representation, warranty, promise or the like not recorded herein. Unless otherwise specifically stated these website terms and conditions supersede and replace all prior commitments, undertakings or representations, whether written or oral, between you and The Property Management Company in respect of your use of the website. The Property Management Company may at any time modify any relevant terms and conditions, policies or notices. You acknowledge that by visiting the website from time to time, you shall become bound to the current version of the relevant terms and conditions (the “current version”) and, unless stated in the current version, all previous versions shall be superseded by the current version. You shall be responsible for reviewing the then current version each time you visit the website.
The contract is between you the person who is renting the Villa and The Property Management Company (MRLP Rentals SL).
2) Formation of the contract
Before making a booking, please contact The Property Management Company to make sure the Villa is available for the dates required. You must send The Property Management Company a completed booking form and payment of a non-refundable deposit of 30% of the property rental. A binding contract between the person who has signed the Booking Form and the Property Management Company will be made when The Property Management Company issue a confirmation invoice. You are responsible for the payment of the price of the full rental and the compliance of the members of your party with these conditions.
Bookings cannot be accepted from persons under 18 years of age at the time of booking. The Property Management Company reserve the right to refuse a booking without giving a reason.
The balance must be paid no later than 10 weeks before departure. Failure to pay the balance on time will constitute cancellation and cancellation charges will become payable in accordance with the paragraph 6. and paragraph 7 below.
If you book less than 10 weeks before departure the full balance of the rental is payable at the time of booking.
Receipt and banking of any deposit does not constitute acceptance of any booking. A binding contract is made when The Property Management Company issue a confirmation notice.
4) The Price
The prices are in sterling and the rental period is weekly, unless otherwise stated. The price does NOT include any locally levied taxes such as Tourist Tax or ECO tax that can be imposed at any point by the Ibizan authorities. This tax can range in price, per person per night and is collected on island either at the airport or by the Villa Management Company.
The Property is let furnished and equipped. The price does not include charges for the use of air-conditioning units in the property, either fixed or portable. If air-conditioning is available in the property, there is a charge of €20 per day for its use. This can be paid locally on arrival. The price also does not include cleaning, a cleaning charge is added to the rental price that covers the full clean at the end of the rental period.
5) Accidental Damage Waiver
We have replaced the traditional large Security Deposit payment with an Accidental Damage Waiver that is added to the cost of your villa rental and paid with your balance.
For a non-refundable charge of £14.95 or the euro equivalent per person payable with your balance, clients will be covered for any accidental damages that occur during their stay in the villa.
The ADW charge will cover you for any non-intentional breakages or damage to the Villa or its contents, up to the value of £1500 per villa or the equivalent in euros per group. Any accidental damage or breakages must be reported while clients are in occupancy of the Villa.
IMPORTANT: The ADW will not cover clients for willful, deliberate or malicious damages to the Villa or its contents, or for damages or breakages that are not reported during the clients’ occupancy of the Villa. It does not cover damage to the pool, or the cost of draining and refilling the pool due to broken glass or other items being found in the pool.
The ADW does not cover fines from the police or other Island Authorities incurred for any type of anti-social behaviour, illegal activity or complaints arising from noise or disturbance.
The ADW does not cover extra cleaning or rubbish removal costs if the Villa is deliberately left in an excessively dirty state.
Any charges the company needs to make due to any of the above circumstances not covered by the ADW, will be invoiced to the Lead Client after departure. In addition, 125 EUROS will be authorised on arrival at check in. The money will not be taken, only authorised. However, if the management team have to remove rubbish at the end of your stay, or carry out extra cleaning, replace items damaged maliciously not covered by ADW, clients who do not check out on time without prior consent, or we have to cover part or the whole of a fine, the money will be taken. If 125 euros is not enough to cover damages or fines the management will invoice the lead client.
6) Alterations or Cancellations
In the unlikely event it is necessary to make an alteration or cancel your villa rental, we will inform you as soon as possible and we will try and arrange alternative accommodation for a villa of a similar type and standard, and in a similar location. It must be noted that villas are private houses and on rare occasions can be sold or the owner can decide to stop renting the house. In such circumstances we will move your group to a similar villa in a similar price band.
7) Cancellation by You
Any cancellation by you for whatever reason must be emailed to firstname.lastname@example.org Telephone: +34 666 934 060.
The effective date of cancellation is the date on which we receive written cancellation.
If you cancel 10 weeks or more before departure you will lose your deposit.
If you cancel within 10 weeks of departure or if the holiday booking is cancelled due to non-payment we are entitled to full holiday cost from you.
If your reservation has been moved from a previous date or year your cancellation is subject to your original contract. It is not possible to ask for a refund if you cancel 10 weeks before the date you move to. For example. If your reservation was moved from 15 May 2020. to 15 May 2021. If you wanted to cancel your reservation without loss of deposit or final balance, you would need to cancel 10 weeks before your arrival on 15 May 2020.
If your group reduces in size and you wish to book a smaller villa, our normal cancellation policy applies.
8) Amendments by you
Upon receipt of your booking confirmation invoice, please check the details to make sure they are correct. If after your booking has been accepted you require us to amend it in any way or re-invoice you, we reserve the right to charge £30 per change.
9) Covid 19
In the event of another outbreak of Covid or imposition of any government restrictions which prevent you, the client from travelling to Spain or prevent the Management Company from providing the service – The following conditions will apply
If you have paid a deposit to secure the villa or your final balance to secure the villa, the deposit or the balance are NOT refundable.
We require a 30% deposit when booking a villa and the balance is due 10 weeks before arrival. Failure to pay the balance on time could result in your booking being cancelled and your dates being released back on sale. If at a later date you decide you wish to continue with your booking and pay the balance, we will re instate the booking subject to availability or offer a suitable alternative. No refunds will be given .
In the event of a Covid outbreak or Government restrictions being put in place which prevent travel the following options are available.
- The Management Company will move your reservation to a later date in the season to a similar price band if or when Government restrictions are lifted.
- The Management Company will attempt to move you to the same villa within the same price band. If we do not have the same villa available on the date the client requests, the Management Company has the right to offer an alternative villa in the same price band within a 20 km radius of the original reservation. It must be noted that villas are private houses and on rare occasions can be sold or the owner can decide to stop renting the house. In such circumstances we will move your group to a similar villa in a similar price band.
- If you the client wish to move your reservation to the following season the Management Company will move your reservation. THIS ONLY APPLIES IF THERE ARE GOVERNMENT RESTRICTIONS PREVENTING YOU FROM TRAVELLING TO SPAIN.
- If your reservation is during a period where Government restrictions prevent you from travelling to Ibiza the move will be made free of charge.
- When the Management Company moves the clients reservation , the Management Company will attempt to move you, the client, to the same villa on the same date. If this is not possible the Management Company will find a similar villa in the same price band. No refunds will be offered. The villa may not be in the same location but will be within a 25 minute drive or 20 km of your previous villa.
- If you, the client wishes to move your booking and there are no Government restrictions in place, this must be communicated to the Management Company by email or in writing up to and including 70 days before your arrival.
- If the client cannot decide what dates at the time of moving your reservation, the Management company will offer a credit note. The credit note can be used within 365 days of issue. Credit notes issued in 2020 must be used by Oct 31 2021 and credit notes issued in 2021 must be used by Oct 31 2022. Clients cannot use a credit note issued in 2020 or 2021 to book a villa in 2023 onwards. Credit notes cannot be carried forward to 2023. Your credit note (valid for 365 days from the date of issue) will be equal to the amount of money you have paid, which can be used against any villa within the same price band. If you cannot come to Ibiza at the same time the following season your credit note can be used in other price bands. No refunds will be offered .
- If your reservation is made under our special offer scheme whereby you the client enjoy a special discount, the special offer will NOT be transferred to the following season. You will be offered a credit note (valid for 365 days from the date of issue) for your reservation equal to the amount of money you have paid, which can be used against any villa within the same price band. If you cannot come to Ibiza at the same time the following season your credit note can be used in other price bands. No refunds will be offered .
- If your group reduces in size the price of your villa rental remains the same. To be clear. The Management Company rents the whole villa and does not base the rent on the size of the group
- If your group wishes to move to another villa, the Management Company will try to help, subject to availability. The group can transfer the money they have paid as payment towards the smaller villa. No refunds will be given from monies already paid to the Management Company.
- Please note. Any PCR tests or any similar Covid tests put in place to allow travel do not constitute a restriction to travel. Compulsory Quarantine after travel, also does not constitute a restriction to travel.
10) Villa Representation
While all the photographs you see and descriptions you read are fundamentally correct, we cannot accept responsibility if minor errors or differences in the photographs / illustrations / text used and the actual property arise.
The Property Management Company reserve the right to make modifications to the property specification that are considered necessary in the light of operating requirements. In the interest of continued improvements, The Property Management Company reserve the right to alter furniture, fittings, amenities, facilities, or any activities, either advertised or previously available, without prior notice.
If material changes occur after your booking has been made we will advise you if there is time before your departure.
11) Number of People using the Villa
Only those persons named on the booking form may use the property without prior arrangement. The number of people staying at the property must not exceed the number of sleeping places indicated in the advertised material, except in the case of infants under two years of ages or written consent from The Property Management Company . The Property Owner and the manager reserves the right to revoke the booking at their sole discretion. This means should we discover more people in the villa than appears on the booking form we have the right to cancel the booking and evict the group immediately or apply a surcharge payable immediately.
The Property Management Company or his/her representative shall be allowed free access to the Villa, owned by The Property Management Company sat any reasonable time during any holiday occupancy for the purposes of inspection and maintenance.
13) Arrival and Departure
You must arrive after 16:00 on the holiday start date, and the accommodation must be vacated by 10:00 on the last day unless otherwise specified by the Property Management Company in writing. If these times are difficult please advise when you are booking. If your arrival is delayed please inform the Property Management Company so that suitable arrangements can be made for entry to the Villa.
Pets are not allowed without prior written permission of the Property Owner. You may be asked to pay a security deposit.
15) Your Responsibilities
You must keep the Villa (holiday accommodation) and all furniture, fittings effects, facilities and equipment in the same state of repair and condition as at the commencement of your holiday or stay. You must leave the Villa (the holiday accommodation) in the same state of cleanliness and general order in which you found it. You are responsible for all damage or loss which occurs to the property or its contents during your occupation and will be responsible for paying appropriate compensation to The Property Management Company in the event of breakages or damage. You must not allow any illegal activities or illegal substances in the premises. You must recognize local noise restrictions, for instance no music outside after 11pm and before 8am. Clients may not bring their own, or externally hired, professional music equipment or amplification devices; these are strictly prohibited. Failure to comply will render the contract null and void and can lead to eviction from the villa, with no reimbursement of monies paid. Clients are also responsible for any local fines for noise or illegal activities. It is worth noting the fine for noise is between 600 euros and 12000 euros. The normal fine is 6000 euros.
In the unlikely event that you are disappointed with the Villa, you must contact the Property Management Company or local representative during your occupancy who will try to solve the problem. If after that you feel that the problems were not sorted out to your satisfaction please write to the Property Management Company within seven days of returning from your holiday at the Villa. If you vacate the property before the end of your rental period without our authorisation you shall lose any rights to compensation. We cannot accept responsibility for any retrospective complaints that have not been reported to us and documented during your occupancy.
17) Liability of us, The Property Management Company
We shall not be responsible for the death of, or personal injury of, you or any person named on the booking form or other person at the property unless this results from the proven negligence of the Property Management Company .
Any accidents which occur whilst you are drunk or under the influence of drugs are not the responsibility of the Property Management company or the owners. We shall not be responsible for any loss, breach or delay beyond our reasonable control, including though, but not limited to, act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, by-laws, or measures of any kind on the part of governmental or local authority, strikes. Lockouts, or other industrial actions or disputes or adverse weather conditions.
We cannot be held responsible for the breakdown of mechanical equipment, such as pumps, boilers, swimming pool filtration systems etc, nor for failure of public utilities such as water, electricity, wifi and TV signals and gas, or for any water wells or cisterns feeding the Villa.
We are not responsible for noise and disturbance originating beyond the boundaries of the Villa or anything which is beyond our control. We are also not responsible for any fines resulting from noise, parties or bad behavior imposed by the police or local authorities
The property will be cleaned throughout at the beginning of the rental period and you must leave it clean throughout at the end of the rental period. Cleaning is not included in the rental price. A cleaning charge is added to the rental which covers the professional clean at the end of the rental period. If the property is left in an unacceptable condition and the cleaners require extra hours over and above the normal cleaning charge, the Property Management Company will charge the lead client for any extra costs related to cleaning and repairing the villa.
The person signing the contract is responsible for the correct and decent behaviour of his / her party. Should you and your party not behave in a decent and suitable manner the Owner, key holder, Property Management Company or Local Representative at his / her absolute discretion can ask you and your party to vacate the property without any refund in the price.
Cleaning staff or additional staff could be provided for an extra cost. Please give us as much notice as possible, but we cannot always guarantee availability. We accept no responsibility for additional staff or services. Any other arrangements you make between your staff or any other person or company providing services when you are at the Villa, are between you and your staff and we accept no responsibility for these services service provided and the terms on which they are provided.
Linen is included in the Villa , but it is advisable to take your own beach towels and cot linen. Linen is normally changed once per week. If you require more frequent changes there will be an extra charge.
22) Swimming Pools
The Swimming Pool will usually be closed in the winter months (November to March) If the rental falls within this period please check with us if the pool is open.
Photographs taken at the Villa cannot be sold for profit without the permission of The Property Management Company .
24) Social Events
It is the policy of the Property Management Company not to allow social events and other functions (e.g. weddings, receptions or Blessing Ceremonies, large outdoor barbecue events etc) on the property without prior agreement with us, the Property Management Company.
25) Security and Valuables
Any valuables left at the property are at your own risk. The Property Management Company, local representative or agents are not responsible for your loss. As with all rental property in prime locations, there is a risk of burglary. The burglar alarms and any security must be activated. It is your responsibility to advise the Property Management Company immediately on arrival if any of the security systems or safety deposit boxes do not work. The property owner will take all reasonable steps to correct any fault but we cannot guarantee to fix the fault during your rental. We accept no responsibility for any loss, damage or consequential losses due to theft or any security related incident however caused. The safety deposit boxes are for the storage of cash, cards, passports etc. In most cases they are not large enough to store multiple mobile phones or other electrical devices. We strongly advise that clients do not bring such items with them, and we cannot be held responsible for their loss or damage should you choose to bring such items with you.
It is a condition of booking that all members of your group are covered by a valid Comprehensive Travel Insurance policy. Please ensure you have arranged sufficient cover for any medical or injury costs and for all your personal belongings.
27) Problems and Faults
Please note: Any problems and faults in the villa, even matters concerning light bulb failure, should be reported to the local representative within a reasonable period of time, for instance 24 hours. We cannot accept retrospective complaints that have not been reported or documented during your occupancy of the villa.
28) Rubbish disposal
It is your responsibility to remove daily rubbish from the premises. In Spain all rubbish is taken to centralised bins which your villa rep will point out to you at check in. Many clients do not have a car therefore we can offer a Rubbish Collection service for just 75 euros plus IVA / VAT of 21% for stays of 1 week or less which your villa rep will collect on arrival at the villa. If you do not wish to use this service ,you will be responsible for removing all rubbish and we will require a credit card at check in to preauthorise 125 euros in the event of any rubbish being left at the premises. This amount will only be taken if any rubbish is left at the villa.
All contractual obligations arising out of these booking conditions shall be deemed to come into existence in Ibiza, Spain and be subject to Spanish Law and the exclusive jurisdiction of the Spanish Courts.
MRLP Rentals SL (The Property Management Company) will rent the customer / client the property for an agreed period. All other services associated with the rental are not included in the price of the rental. Any services must be paid directly to the supplier.
